Land for Sale Near Morgan Mill TX: How the Contract, the Survey, and the Title Work Together

When you buy a house in town, the contract, the inspection, and the lender do most of the heavy lifting. Buying land near Morgan Mill is different. The survey and the title matter more, and the contract has to say what you're actually getting. Texas updated its land contract forms on July 1, so this is a good time to go over how the pieces fit.

What changed in the Texas land contracts?

The Texas Real Estate Commission (TREC) lists the Farm and Ranch Contract (25-17) and the Unimproved Property Contract (9-18) among the forms with a 07/01/2026 effective date. TREC's page says real estate license holders are required to use these forms. The same list includes the new Seller's Disclosure about Groundwater and Surface Water Rights (see my Dublin post).

A title company's summary of the 2026 contract changes also mentions clearer language about broker compensation, notice delivery, and reorganized addenda, and a defined "Legal Holiday" for deadline counting. I'd treat that summary as a guide and read the actual forms.

What does a land buyer need besides the contract?

Texas A&M AgriLife Extension's Texas Agriculture Law blog posted a Texas Rural Land Purchasing Checklist on June 8, 2026 (by Kara Matheney and Karli Kaase). Several of its points line up with the contract:

  • A current survey. The checklist says a current survey is strongly recommended to confirm boundaries, acreage, legal access, and any encroachments or rights-of-way. An outdated or missing survey is a red flag.
  • Title review. It calls careful title review essential, covering ownership history, deed restrictions, easements, liens, leases, and tax status. Title insurance can reduce ownership risk.
  • Severed rights. Mineral rights, groundwater rights, and even wind rights may have been severed or reserved, so confirm which rights actually transfer.
  • Easements and access. Road, utility, and pipeline easements can limit how you use the land. Unclear or disputed legal access is a red flag.
  • Permits. Identify early what's required for septic, water wells, and driveway access.
  • Ag valuation. Check the use history, the acreage and intensity standards, and the rollback tax risk if the use changes. Contact the appraisal district early.

What does it mean for buyers and sellers near Morgan Mill?

Morgan Mill is an unincorporated community in Erath County, about 10 miles north of Stephenville on US-281. There's no city government, so a lot of the rules that would normally come from a city don't apply, and more of the checking falls on you. I cover that in my earlier Morgan Mill post.

  • Buyers: Make the survey, title commitment, and any needed permits part of your timeline from day one. Land deals often take longer than house deals because of this.
  • Sellers: The easiest listings to sell are the ones with a recent survey, clear access, and a title company that's already seen the deed chain. If you have older surveys, consider updating them.
  • Everyone: If a tract is a piece of a larger parcel, ask about access and whether the land was divided properly.

My take: what I'd do right now

  1. Read the contract before you're in love with the land. Ask your agent to walk through the survey, title, and access paragraphs.
  2. Order the survey and title commitment first. If something is wrong, you want to learn it early in your option period.
  3. Get the access in writing. Know whether you're on a county road or a recorded easement.
  4. Ask about minerals and water. If they've been severed, find out what that means for your plans.
  5. Call the appraisal district about the current valuation and what you'd need to do to keep it.
  6. Run it by an attorney for anything unusual. TREC doesn't give legal advice, and neither do I.
